The website www.mythfactoryshop.com, hereinafter referred to as the “Site”, is operated by:

MYTH FACTORY is a Belgian retailer specialising in the sale of officially licensed figures, statues and other collectibles.

The products offered on the Site are collectibles intended for adults. They are not intended to be used as toys by children unless explicitly stated otherwise on the product page.

Any order implies consultation and unconditional acceptance of these General Terms and Conditions of Sale, hereinafter referred to as the “Terms and Conditions”.

The customer acknowledges having read the Terms and Conditions and the information applicable to their order before confirming it.

Article 1 – Scope and contractual documents

These Terms and Conditions govern distance sales concluded through the Site between MYTH FACTORY and any natural or legal person placing an order.

Where the customer acts for purposes outside their trade, business or profession, they also benefit from the mandatory consumer protection provisions applicable to them.

The following sections of the Site also form part of the contractual information applicable to orders:

Pre-orders – Payment – Returns and refunds – After-sales service – Shipping.

These sections specify the practical arrangements applicable to the matters they govern.

In the event of a conflict between a general provision of these Terms and Conditions and a specific provision contained in one of these sections concerning the matter it governs, the specific provision shall prevail.

The applicable version is the version in force at the time the order is confirmed.

The order summary, the characteristics stated on the product page and any special terms expressly accepted when placing the order complete the contractual framework.

Article 2 – Products

2.1. Characteristics

MYTH FACTORY presents the main characteristics of the products offered for sale on the Site.

Photographs, illustrations, prototypes, promotional visuals and descriptions supplied by manufacturers are provided in order to present the products as faithfully as possible.

In the collectibles sector, manufacturers may nevertheless make certain changes to the final product during its development or production.

Slight variations in colour, texture, finish or positioning may also result from the manufacturing process.

2.2. Availability

Products are offered subject to available stock or to the quantities that can be obtained from manufacturers and distributors.

The indications “in stock”, “on order” or “pre-order” correspond to the known status of the product at the time the Site is consulted.

MYTH FACTORY reserves the right to cancel an order if a product becomes permanently unavailable from the manufacturer or distributor. Any sums paid for the product concerned will then be refunded.

2.3. Products intended for adult collectors

The products sold on the Site are primarily intended for display and collecting.

Some products may include small parts, fragile components, sharp points, materials requiring specific precautions or complex assembly mechanisms.

The customer must comply with the manufacturer's instructions and handle the products with the care appropriate to their nature.

Article 3 – Prices

The applicable prices are those displayed on the Site at the time the order is confirmed.

Prices are expressed in the currency displayed to the customer and include, where applicable, the VAT rate corresponding to the country of destination in accordance with the applicable tax rules.

Shipping costs include transport insurance and are shown separately before final confirmation of the order.

These amounts never include any customs duties, import taxes, customs clearance fees or other charges payable in the country of destination, which remain the responsibility of the recipient.

MYTH FACTORY may change its prices at any time. A subsequent change in the price of a product will not, however, affect an order that has already been validly concluded, subject to an obvious pricing error.

In the exceptional event of an obviously incorrect price resulting from a technical, IT, typographical or human error, MYTH FACTORY may cancel the order and will refund all sums received.

For products reserved by pre-order deposit, the product price is fixed at the time of reservation. Any shipping costs still to be paid are calculated according to the rates applicable at the time the balance is paid and the shipment is prepared.

Article 4 – Orders

The customer selects the desired products and adds them to their shopping cart.

Before final confirmation, the customer can check the contents of the order, quantities, prices, delivery address, delivery method and payment method.

Completion of payment results in the conclusion of the sales contract.

A confirmation is sent by email to the address provided by the customer.

The customer is responsible for the accuracy of the information provided when placing the order.

An order that has already been confirmed cannot be modified to add additional products. A new order must be placed.

MYTH FACTORY may refuse a new order for a legitimate reason, particularly in the event of previous non-payment, fraud or attempted fraud, an unjustified payment dispute, abusive behaviour, fraudulent use of the Site's services or previous failure to comply with the customer's contractual obligations.

Article 5 – Payment

5.1. Payment methods

Depending on the country, the amount and the nature of the order, the payment methods offered may include debit and credit cards, PayPal, SEPA bank transfer and instalment payment solutions offered by Alma or PayPal.

The payment methods actually available are displayed to the customer when placing the order.

Instalment payments are offered and managed by the relevant payment providers in accordance with their own eligibility and financing conditions.

Where an instalment payment has been accepted by the provider and the products are available, shipment is not conditional upon the customer having paid all future instalments to the financial provider.

5.2. Payment by bank transfer

Where payment by bank transfer is selected, payment must reach MYTH FACTORY within a maximum of seven (7) calendar days from the date of the order.

If payment is not received within this period, the order may be automatically cancelled.

5.3. Modification of an order or payment method

Where, at the customer's request, MYTH FACTORY must refund a transaction in order to change a payment method or cancel or modify an order that has already been invoiced but not shipped, the payment and processing costs generated by this operation may be charged back to the customer at a rate of 4% of the amount concerned.

These charges may also apply where a refund or cancellation results from an attempt to circumvent these Terms and Conditions or from the recipient's refusal to complete the customs clearance formalities for which they are responsible.

This provision does not limit the customer's mandatory rights where the cancellation or refund results from the valid exercise of a right provided by law or from a failure attributable to MYTH FACTORY.

Article 6 – Pre-orders

6.1. Definition

A product offered for pre-order is a product that is not yet available in stock but can be reserved before its release or arrival within the European distribution network.

A pre-order allows the customer to reserve one unit from MYTH FACTORY.

Excluding sales, temporary promotions, clearance operations, discounts, promotional codes or other special commercial operations, the price paid for a pre-ordered product will be lower than or equal to the normal selling price at which the same product will be offered when it arrives in stock.

6.2. Availability dates

The availability dates displayed on the Site are provided by manufacturers, importers or distributors.

They are estimates and are not guaranteed.

Manufacturers may change their production schedules and importers may change their distribution schedules without MYTH FACTORY being able to intervene in these decisions.

Delays of several months are common in the collectibles sector. Some manufacturers may exceptionally experience longer delays.

The date shown on the product page and in the customer's personal account is the most recent information available to MYTH FACTORY.

Where a manufacturer delivers the same product in several waves, the estimated date displayed corresponds to the period during which MYTH FACTORY expects to receive the last units due to be delivered to it.

Products manufactured in Asia may be released several months earlier on Asian or American markets than on the European market. The publication of photographs, videos or reviews of the final product in other regions of the world therefore does not mean that the product is already available from the European importer.

Customers are advised not to reserve a pre-order product if they absolutely need to receive it before a particular occasion or date.

6.3. Full payment or deposit

Depending on the options available on the product page, a pre-order may be paid in full at the time of ordering or reserved by paying a deposit.

The option to reserve with a deposit may be withdrawn as the product's arrival approaches, particularly during the month preceding its availability.

A customer who has paid a deposit may pay the outstanding balance at any time from their personal account.

Otherwise, MYTH FACTORY will normally send a payment request approximately fifteen days before the product's expected arrival.

From the date of this request, the customer has seven (7) calendar days to pay the balance.

If payment is not made within this period, the pre-order may be cancelled and the deposit paid will not be refunded.

6.4. Cancellation of a pre-order at the customer's request

MYTH FACTORY reserves from its suppliers the units ordered by its customers and assumes the resulting purchasing, storage and management obligations.

Where a customer cancels on their own initiative a pre-order reserved by deposit, the deposit paid is non-refundable.

Where a pre-order has been paid in full, cancellation at the customer's request results in a refund of the amount paid less a non-refundable deposit corresponding to 15% of the product price.

These conditions constitute the specific cancellation terms for pre-orders accepted at the time of reservation.

6.5. Delay exceeding six months

Given the lead times inherent in the production and importation of collectibles, the customer accepts that the initially announced estimated date may be delayed.

However, where the estimated availability date communicated at the time of the pre-order is exceeded by more than six months, the customer may request cancellation of the pre-order and a full refund of all sums paid for it, without any penalty.

6.6. Failure to pay the balance of a pre-order reserved by deposit

Where a pre-order has been reserved by paying a deposit, the customer undertakes to pay the balance within the period provided for in Article 6.3 after receiving the payment request.

If the balance is not paid within this period, MYTH FACTORY may cancel the pre-order and the deposit paid will be retained in accordance with the cancellation terms accepted at the time of reservation.

Failure to pay the balance may also result in the suspension of shipment of other available goods and the refusal of new pre-orders or orders until the situation has been regularised.

In the event of refusal to honour the contractual commitments associated with a pre-order, MYTH FACTORY may also cancel any other outstanding pre-orders in accordance with the cancellation terms applicable to each of them.

6.7. Orders containing several products

An order is shipped when all fully paid products contained in it are available.

It is not possible to request partial shipment of products belonging to the same order.

Products pre-ordered using a deposit only do not block shipment of the other fully paid products in the order. They will be shipped after payment of their balance and the corresponding shipping costs.

Article 7 – Shipping and delivery

7.1. Delivery times

The transit times shown on the Site are estimates and may vary depending on the carrier, destination, periods of high activity and customs formalities.

A tracking number or link is provided where the shipping service used allows it.

7.2. Shipping costs

Shipping costs include packaging, handling, transport and insurance costs.

As carrier rates are regularly indexed, the applicable charges are those calculated when the relevant shipment is invoiced.

Certain specific destinations, particularly islands or regions considered remote by carriers, may be subject to a surcharge.

Where a surcharge cannot be calculated automatically when the order is placed because of an error in the delivery address entered by the customer, MYTH FACTORY may request payment of this surcharge before shipment.

The shipping costs charged by MYTH FACTORY do not include customs duties, import taxes, customs clearance fees or other charges that may apply in the country of destination. These amounts are payable to the authorities of the destination country and are invoiced or collected from the recipient by the carrier responsible for customs clearance.

7.3. Choice of carrier

MYTH FACTORY may use different shipping networks depending on the destination, weight, value and dimensions of the parcel.

In the event of disruption to a network, dimensional constraints or specific operational circumstances, MYTH FACTORY may entrust the shipment to another carrier offering a comparable service or redirect the shipment to an appropriate collection point where home delivery cannot reasonably be carried out.

7.4. Address and receipt

The customer is responsible for the accuracy and accessibility of the delivery address provided when placing the order.

Once an order has been registered, the delivery address associated with it can only be changed by written request sent to [email protected].

Any subsequent change of address in the customer's personal account has no effect on the delivery details already recorded for an existing order.

The customer must therefore check the details shown in the order confirmation and contact MYTH FACTORY as quickly as possible if a correction is required.

The customer must take the steps reasonably necessary to receive the order, including following the carrier's information, responding to requests necessary for delivery and collecting within the required time any parcel made available at a collection point or post office.

Additional costs resulting from an incorrect address, failure to collect, unjustified refusal of delivery or failure by the recipient to fulfil their obligations may be charged to the customer.

7.5. Parcel not collected from a collection point

A customer who has selected or accepted delivery to a collection point is responsible for collecting the parcel during its availability period.

Where a parcel is returned to us because it was not collected, a flat-rate return charge of €10 including VAT, together with the cost of any new shipment, will be payable before the parcel is sent again.

If these charges are not paid within seven days, the order may be cancelled and refunded in accordance with the conditions applicable to its contents.

7.6. Shipments outside the European Union and customs clearance

Orders shipped outside the European Union may be subject to customs duties, local taxes, administration fees or other formalities imposed by the authorities or carrier in the destination country.

These amounts are not included in the shipping costs charged by MYTH FACTORY.

The recipient is responsible for providing any information requested by the authorities or carrier and for paying the amounts requested locally.

MYTH FACTORY is not responsible for these duties, taxes, formalities or customs clearance times.

If an order is returned as a result of refusal to complete customs clearance or lack of cooperation by the recipient, the costs arising from the return, the procedure and the processing of the transaction may be deducted from the refundable amount in accordance with these Terms and Conditions.

7.7. Delivery problem

Any apparent damage to the parcel, loss, delivery error or other transport-related problem must be reported to MYTH FACTORY within two business days of receipt or discovery of the problem.

Prompt notification is essential to allow MYTH FACTORY to open a claim with the carrier and its insurer within the required time limits.

Article 8 – Grouped shipments

8.1. Automatic grouping

Where several orders from the same customer become ready for shipment at the same time, particularly following the simultaneous arrival of several pre-orders, MYTH FACTORY will automatically combine them into a single parcel.

After shipment, the shipping costs already paid are reconciled. Any difference in the customer's favour is credited as a voucher.

8.2. Grouped shipping on request

Where this option is offered when placing an order, the customer may select “Hold shipment to ship with other orders”.

The order then remains on hold until the customer expressly requests shipment from their personal account.

This option means that the final shipping costs are calculated and paid when the customer requests shipment of the group of orders.

It is not possible under this procedure to group an order for which shipping costs have already been calculated and paid.

Payment of the balance of a reservation initially made by deposit constitutes a separate transaction from a logistics perspective.

The maximum period for which an order may be held as part of a grouped shipment is one year from the date on which that order was placed.

8.3. Conditions for grouped shipping on request

A grouped shipment must include at least two different order references.

The total weight of a grouped shipment is limited to 20 kg. If this limit is exceeded, several parcels may be required and the charges will be adjusted accordingly.

Partial shipment of products belonging to the same order is never possible.

8.4. Maximum holding period

Shipment of orders placed on hold as part of a grouped shipment may be suspended for a maximum period of one year from the date each order was placed.

At the end of this period, if no instructions have been received from the customer and the shipping costs have not been paid, the orders concerned may be cancelled.

Any refundable amounts will then be credited in the form of a voucher valid for one year.

Cancellation of a pre-order remains subject to the specific conditions set out in Article 6, including retention of the non-refundable deposit where applicable.

Article 9 – Right of withdrawal, returns and refunds

9.1. Return period

The customer has thirty calendar days from the day following delivery to request the return of a product, subject to compliance with the conditions set out in this Article.

9.2. Required condition of returned products

The products sold by MYTH FACTORY are collectibles whose original packaging, seals, protective materials and presentation form an integral part of their commercial value.

Any returned product must be new, complete, intact, unopened and perfectly sealed in its original packaging.

A product that has been opened, unsealed, used, assembled, displayed, is incomplete or damaged, or whose packaging has been altered, cannot be accepted for return or refunded.

Opening packaging or breaking a seal changes the commercial value of the collectible and means that MYTH FACTORY can no longer sell it as a new product.

9.3. Mandatory prior authorisation

Any return must receive prior authorisation from MYTH FACTORY before it is shipped.

The customer must contact MYTH FACTORY at [email protected], stating the order reference, the product concerned, the reason for the return and its condition.

This procedure makes it possible in particular to check in advance whether the product meets the return conditions and to inform the customer before they incur shipping costs.

MYTH FACTORY may request photographs to verify the condition of the product and its packaging before authorising the return.

Once the return has been authorised, the product must be sent to:

No return sent without prior authorisation will be accepted.

9.4. Return transport

The customer is responsible for adequately packaging the returned product and must use a shipping method that provides proof of dispatch.

Where return shipping costs are the customer's responsibility, any loss or damage occurring during return transport remains the customer's responsibility.

9.5. Depreciation of packaging during return transport

MYTH FACTORY supplies its customers with new, sealed products whose boxes are in perfect condition, corresponding to a C10 condition.

Where packaging is damaged during return transport, the loss in value of the product is assessed using the same reference system that MYTH FACTORY applies when selling products received from its suppliers with a damaged box.

The following categories and depreciation rates apply:

Box with a minor defect – 10% depreciation:

the packaging has one or more creases/cracks in the cardboard and/or a slightly crushed corner.

Damaged box – 15% depreciation:

the packaging has a very visible defect while still continuing to perform its protective function.

Heavily damaged box – 30% depreciation:

the condition of the packaging is such that it no longer properly performs its protective function.

Where the condition of the packaging requires the product to be opened in order to check the integrity of its contents, the additional loss in value resulting from this opening may also be taken into account.

Where the contents themselves are damaged to the point of making the product unsaleable, the loss in value may amount to the full value of the product.

9.6. Refund

The refund is made after receipt and inspection of the returned product.

Return shipping costs remain the customer's responsibility unless a contrary provision expressly applies.

The specific cancellation conditions for pre-orders, including the 15% non-refundable deposit, continue to apply where their application is provided for under Article 6.

The refund is made using the appropriate method having regard to the original payment.

Where a refund to the original payment method is technically impossible, particularly because of the age of the transaction, MYTH FACTORY will contact the customer to agree on an appropriate alternative method, such as bank transfer, PayPal or, with the customer's agreement, a voucher.

9.7. Refusal of delivery or failure to collect used as a means of return

Refusing a parcel or failing to collect it from a collection point does not constitute a valid return procedure.

Where a parcel is returned to us in these circumstances, the return costs, set at a flat rate of €10 including VAT, may be deducted from the refundable amount where these costs are attributable to the customer.

Article 10 – Legal guarantee and after-sales service

10.1. Legal guarantee

The consumer benefits from the legal guarantee of conformity applicable to consumer goods.

Where the legal conditions are met, the consumer may request that the goods be brought into conformity, in particular by repair or replacement, depending on what is possible and proportionate.

10.2. Reporting defects within 48 hours

Any defect, broken part, missing part, paint issue or other anomaly identified when unpacking must be reported to MYTH FACTORY within 48 hours of receipt.

This period is essential in order to establish that the defect or damage was present upon receipt and was not subsequently caused by improper handling by the customer, and to provide the manufacturer or importer with the information required to assess the claim.

The customer must provide clear, precise photographs taken in good lighting conditions and clearly showing the issue.

The order reference must be provided.

Any additional requirements imposed by the manufacturer must also be complied with.

10.3. Assessment by the manufacturer or importer

As part of the processing of an after-sales service claim, MYTH FACTORY may forward the information and photographs to the European importer and the manufacturer.

The manufacturer and/or importer acts as a technical expert in order to assess, in particular, the nature of the defect, whether it falls within the product's production tolerances, its possible origin and whether the damage is consistent with normal use.

Depending on the outcome of this assessment, the solution may include a replacement part, complete replacement, repair, compensation or any other appropriate solution.

MYTH FACTORY remains the customer's point of contact for the processing of the claim.

10.4. Manufacturing tolerances

Collectibles are products manufactured and painted using industrial or semi-handcrafted processes.

Under the after-sales criteria communicated and applied by manufacturers/importers, the following are in particular considered to fall within normal manufacturing tolerances:

  • paint or finish defects measuring no more than 2 mm;
  • defects that are only visible from a distance of less than 30 cm or under glancing light;
  • parts that are normally fitted and glued together but have simply come apart and can be put back in place by adding a small amount of glue.

These issues do not qualify for replacement under the manufacturer's after-sales procedure.

10.5. Mattel, Hasbro and similar product ranges

Certain products manufactured in particular by Mattel and Hasbro, as well as certain toy ranges such as M.A.S.K. products manufactured in collaboration with The Loyal Subjects, meet the industrial standards specific to their category rather than those of a high-end statue or figure.

Minor paint or finish imperfections considered by these manufacturers to comply with their production tolerances do not qualify for replacement under their after-sales procedure.

10.6. Improper handling

The guarantee and after-sales service do not cover damage resulting from improper handling, dropping, an attempted repair, modification, incorrect assembly, excessively rough handling or use contrary to the instructions or intended purpose of the product.

Products must be assembled and handled with the care appropriate to their nature as collectibles.

10.7. Replacement and destruction of a defective item

Where a manufacturer agrees to replace an entire product without requiring the defective item to be physically returned, it may require its destruction and photographic proof before authorising MYTH FACTORY to ship the replacement.

Where this procedure is required by the manufacturer or importer, shipment of the replacement is conditional upon compliance with it.

10.8. After-sales service times

Replacement parts generally come from manufacturers located in Asia and are frequently included in the next sea shipments to the European importer.

Resolution times are therefore indicative.

As a general indication, MYTH FACTORY observes lead times of approximately two months for certain Bandai Tamashii Nations products and four to six months for many other manufacturers.

These times may vary depending on the availability of parts, production, transport and the manufacturer's decisions.

Article 11 – Product boxes and packaging

For collectibles, the retail packaging contributes to the value of the product.

MYTH FACTORY takes particular care when packing shipments in order to reduce the risk of damage during transport.

A minor purely cosmetic imperfection in the packaging that does not affect the product or its use may be assessed according to the specific criteria published on the Site.

In the event of a return, damage to the packaging may result in depreciation in accordance with Article 9.

Article 12 – Payment disputes, chargebacks and PayPal disputes

12.1. Principle

If a customer encounters a problem concerning an order or payment, they are asked to contact MYTH FACTORY before initiating a bank chargeback or a dispute with a payment provider.

Opening a chargeback or dispute transfers all or part of the financial handling of the case to the bank, card issuer or payment provider and may limit MYTH FACTORY's ability to intervene directly.

12.2. Account suspension

As soon as MYTH FACTORY is informed that a chargeback or dispute has been opened, the customer account may be temporarily suspended, together with the processing and shipment of the orders associated with it.

This suspension remains in place until the situation has been sufficiently clarified or the payment provider has closed the case.

Chargeback procedures may take several weeks.

12.3. PayPal disputes

Where a PayPal dispute has been opened, communications relating to the case must be centralised in the PayPal Resolution Center for the entire duration of the dispute.

The customer and MYTH FACTORY use this interface so that all exchanges and documents required to review the case can be taken into account by PayPal.

12.4. Dispute opened by mistake

Where a chargeback or dispute has been opened by mistake, the customer is asked to request its immediate withdrawal from their bank or to close the case in accordance with the procedure of the relevant payment provider.

12.5. Unjustified dispute or circumvention of the Terms and Conditions

MYTH FACTORY considers it particularly serious to use a chargeback or dispute procedure in order to obtain, through a payment provider, a refund to which the customer is not entitled under the contractual conditions they accepted.

Disputes may in particular be considered unjustified or abusive where they are based on a manifestly inaccurate statement, challenge a transaction that was validly authorised and correctly performed, attempt to obtain a double refund, or use a chargeback solely to circumvent pre-order cancellation terms, a customs clearance obligation or any other obligation expressly accepted when placing the order.

Any chargeback or dispute considered unjustified, abusive or intended to circumvent these General Terms and Conditions of Sale may, from the first incident, result in the permanent closure of the customer account and refusal of any new order.

In such a situation, MYTH FACTORY may also cancel any orders and pre-orders still pending, in accordance with the cancellation conditions applicable to them.

For pre-orders, such cancellation will in particular result in the application of the provisions of Article 6 concerning the non-refundable deposit.

Article 13 – Suspension, refusal of orders and account closure

MYTH FACTORY may suspend or close a customer account and refuse future business relations where a legitimate reason justifies that decision.

Such reasons may include, in particular: fraud or attempted fraud; use of false information; non-payment of an order; non-payment of the balance of a pre-order; an unjustified chargeback or dispute; abusive use of return or after-sales procedures; threats or seriously abusive communications towards staff; an attempt to deliberately harm the company using manifestly false information; or any conduct that makes the continuation of a normal business relationship reasonably impossible.

The status of any orders or pre-orders still in progress is determined in accordance with these Terms and Conditions and the circumstances that led to the closure of the account.

Article 14 – Liability

MYTH FACTORY is responsible for the performance of its obligations within the limits provided for by the applicable legislation.

MYTH FACTORY cannot, however, be held liable for damage resulting from improper use of the product, inappropriate handling, failure to comply with the manufacturer's instructions or an event attributable to the customer or a third party.

Information supplied by manufacturers concerning release dates, provisional dimensions, prototypes or characteristics that may be changed is reproduced on the Site in good faith and updated when new information is provided.

MYTH FACTORY cannot be held liable for production decisions, postponements or changes decided independently by manufacturers and distributors, subject to the applicable legal obligations.

Article 15 – Force majeure

Neither party may be held liable for any delay or non-performance resulting directly from an event of force majeure within the meaning of the applicable legislation.

Where they meet the legal criteria for force majeure, such events may include natural disasters, fires, armed conflicts, government measures, widespread transport disruptions, strikes affecting essential infrastructure, major network interruptions or other events beyond the reasonable control of the party concerned.

The affected party shall inform the other party within a reasonable period and take all reasonably possible measures to limit the consequences of the event.

Article 16 – Personal data

Personal data provided by the customer are processed in particular for the management of accounts, orders, payments, deliveries, after-sales service requests, fraud prevention, accounting obligations and business relations.

Detailed information on data processing, the applicable legal bases and the rights of data subjects is set out in the Privacy Policy published on the Site.

Article 17 – Evidence, archiving and communications

Data recorded in the IT systems of MYTH FACTORY and its service providers constitute evidence of orders, payments and communications between the parties, subject to any admissible evidence to the contrary.

The customer is responsible for the validity of the email address registered on their account and must ensure that they are able to receive communications relating to their orders.

Information relating to orders and pre-orders is also accessible from the customer's personal account where this functionality is available.

The customer is advised to retain order confirmations, invoices and contractual communications.

Article 18 – Amendments to the Terms and Conditions

MYTH FACTORY may amend these Terms and Conditions, in particular to take account of legislative, regulatory or technical changes or changes to its business organisation.

The new conditions apply to orders concluded after they enter into force.

A subsequent amendment to the Terms and Conditions does not retroactively alter the contractual conditions applicable to an order that has already been concluded.

Article 19 – Severability

If any provision of these Terms and Conditions is declared void, unenforceable or contrary to a mandatory provision, this shall not affect the validity of the other provisions.

The provision concerned shall be disregarded or applied to the maximum extent permitted by the applicable legislation.

Article 20 – Complaints and amicable settlement of disputes

In the event of a problem, the customer is invited to contact MYTH FACTORY first in order to seek an amicable solution.

Recourse to mediation does not deprive either party of the right to bring proceedings before a competent court.

Article 21 – Applicable law and competent courts

These General Terms and Conditions of Sale are governed by Belgian law.

This choice of law does not, however, deprive a consumer residing in another country of any mandatory protections available to them under the legislation applicable to them.

Failing an amicable settlement, any dispute shall be brought before the competent court determined in accordance with the applicable legal rules.
